California bans public officials from issuing memecoins, effective 2027

The Memecoin Ban

Assembly Bill 2409, introduced by Assembly Member Avelino Valencia on February 20, 2026, now adds a ban on issuing memecoins to the California Government Code. The law applies to tokens issued on or after January 1, 2027.

The measure targets a growing tension between political figures and crypto. Newsom criticized US President Donald Trump's crypto ventures, specifically Trump's launch of a memecoin in 2025. The governor framed the legislation as a safeguard against self-dealing.

Enforcement and Scope

California's attorney general, a district attorney, a city attorney or county counsel can enforce the prohibitions by filing a civil action. The law casts a wide net—it doesn't just bar officials from launching tokens directly. It also prohibits digital asset service providers from offering certain memecoins issued by or in partnership with federal, state or local public officials to California residents.

Broader Crypto Regulation

Newsom also signed Senate Bill 1208, which expands California's existing money laundering statutes to include illicit transactions made using digital assets. The law broadly authorizes law enforcement to freeze, seize and forfeit digital assets linked to crimes. Together, the two bills represent California's most aggressive regulatory push on crypto in 2026.
