The regulatory clarity gap
Kulechov's thesis centers on a familiar problem: DeFi protocols currently operate in a gray zone where the SEC, CFTC, and state regulators all have overlapping and sometimes contradictory claims to jurisdiction. This mirrors the limbo stablecoins faced before the GENIUS Act was signed into law on July 18, 2025, establishing the first federal licensing and reserve framework for stablecoin issuers.
The CLARITY Act aims to end that ambiguity. Section 401 of the bill would authorize banks to provide digital asset services including custody, staking, and lending, opening institutional pathways that have remained closed. The draft also includes a safe harbor provision from money transmitter regulations embedded through the Blockchain Regulatory Certainty Act component.
Momentum and support
The bill cleared the Senate Banking Committee with a 15-9 vote, signaling bipartisan traction. Financial heavyweights like Fidelity and Goldman Sachs have also signaled support, lending institutional weight to the effort.
Aave hasn't been subtle about its advocacy. The protocol's leadership has spent over a year conducting lobbying efforts in Washington to support the CLARITY Act's passage. That investment reflects the stakes: a clear regulatory framework could unlock institutional participation in DeFi at scale.
What comes next
The cloture vote scheduled for September 15 is procedural, not final passage. It requires 60 votes to end debate and move to a final vote. The latest draft also includes some concessions to Democratic demands, notably ethics rule adjustments and a Treasury mechanism designed to manage stablecoin deposit risks.
Whether these compromises hold or splinter the coalition remains uncertain. But for Kulechov and the DeFi community, the CLARITY Act represents something DeFi has lacked for years: a path out of regulatory limbo.
